Types of Child Custody

There are four types of child custody in Florida:

  • Physical custody. When people talk about custody of a child, they are most likely thinking about physical custody. Physical custody refers to the child spending time with their parents in their homes. Many couples share custody of their children.
  • Legal custody. Legal custody refers to the ability of a parent to make decisions regarding the child’s education, health, and upbringing. This includes where the child goes to school, what type of medical care the child will receive, and what religion they will be, if applicable. Florida courts typically grant legal custody to both parents following a divorce, so the parents will have to cooperate to make decisions regarding the child’s development.
  • Sole custody. Sole custody is when only one parent has custody of the child. This is not common and is done in situations where a parent is abusing alcohol or drugs, abuses the child, or is otherwise not fit to care for the child.
  • Joint custody. Florida and most other states tend to lean toward joint custody, as this in the best interests of the child. In joint custody, both parents share custody of the child. The couple works together to come up with a schedule of when each of them will be with the child. This is easier when they live near each other.

Parenting Plans

In every divorce that involves a minor child, a parenting plan is required. Parenting plans cover various parenting issues, including parental responsibility, co-parenting, and communication between parents and children. A main component is a timesharing schedule, which addresses when each parent will spend time with the children. It also details how each parent will participate in the upbringing of the children. Every timesharing plan must be in the best interest of the children in order to be approved by the court.
