What is Mediation Law in Tampa?

In Tampa, mediation law is one form of alternative dispute resolution (ADR) that allows parties involved in a legal dispute to resolve the issue without civil litigation.

Mediation law in Tampa is governed by statutory law (Fla. Stat. §§ 44.1011-44.407). According to the Florida Statutes, mediation is “a process whereby a neutral third person called a mediator acts to encourage and facilitate the resolution of a dispute between two or more parties.” Further, the Florida Statutes clarify that mediation is “an informal and non-adversarial process with the objective of helping the disputing parties reach a mutually acceptable and voluntary agreement.” In mediation, the disputing parties are the ones who make any decisions to resolve the dispute.

How Tampa Mediation Law Works

In mediation, the parties will enter into a space with the mediator, who will facilitate dialogue between them. It is important to know that a mediator does not act like a judge in any capacity and does not hear from the two sides of the case. Further, the mediator does not issue a decision or a ruling. Instead, the mediator helps the parties communicate so that they can reach a resolution themselves.

Any resolution reached in mediation will only be binding if the parties agree. If the parties do not agree, they can turn to litigation or other forms of ADR.

Benefits of Tampa Mediation Law

There are many significant benefits to choosing mediation in order to resolve a dispute. When you go through mediation and reach an agreement, you can enjoy some of the following benefits:

  • Save time and money since a court will not have to hear both sides and resolve the dispute;
  • Maintain confidentiality because all matters that come up in mediation are private and are not accessible to the public, unlike issues that arise in a court case;
  • Improve communication skills with the other party, which can be especially important in cases where the disputing parties will share child custody and engage in co-parenting; and
  • Have control over the outcome of your case since you will play a key role in resolving the dispute instead of leaving the decision up to a judge.
